If you are planning a demolition, a gut renovation or a heavy cleanout that involves tearing anything
out, the schedule starts with one rule. New York City permits construction from 7:00am to 6:00pm
on weekdays
. This guide covers everything that sits on top of that rule, based on the city's own
noise and building requirements.

The core rule and its exceptions

  • Permitted hours: 7am–6pm, Monday to Friday.
  • Everything else, including all weekend work, needs an After Hours Variance
    (AHV)
. DOB issues variances for building work and DOT for work in the street.
  • The noise plan comes first: every construction job must have a Construction Noise
Mitigation Plan before work begins. The plan is referenced in the DOB permit application and must be
in place before an AHV can be requested.
  • Posting: the Construction Noise Contact Sheet goes on the fence or door outside the
site, and a granted variance gets posted too.

Buildings with their own rules

Co-ops, condos and commercial landlords set working hours in alteration agreements and construction
rules, and they are almost always narrower than the city's. Where the building is stricter, the building
decides. Its elevator and hallway rules decide when debris can move. Our
co-op and condo COI guide covers the insurance
side of the same agreements.

Occupied units

If dwelling units stay occupied during an alteration or partial demolition, DOB requires a tenant
protection plan, prepared by a registered design professional and approved before the permit is issued.
Hours are one part of protecting residents. Dust, egress and fire safety are the others.

Complaints and violations

Neighbours report after-hours work through 311, and an inspection can follow. Working outside permitted
hours without a posted variance is a violation that attaches to the job. It is the most avoidable
violation there is.

Long Island is different

Nassau County towns and villages each set their own construction hours and weekend rules. We confirm
the hours with the local building department for every Long Island address before scheduling.

Frequently Asked Questions

What are the construction hours in NYC in 2026?

7:00am to 6:00pm on weekdays. Work at any other time, including weekends, requires an After Hours Variance.

How do you get an after-hours construction permit in NYC?

The contractor applies to DOB (or DOT for street work) for an After Hours Variance, with a Construction Noise Mitigation Plan already in place. The variance lists the approved dates and hours.

Can a co-op restrict hours beyond the city rule?

Yes. Alteration agreements usually set shorter hours, and when the building's rules are stricter, they govern the job.

Do Long Island towns follow NYC construction hours?

No. Nassau towns and villages set their own hours. Check with the local building department for the property's address.
